Fair Labor Standards Act (FLSA)

The Fair Labor Standards Act (FLSA) establishes minimum wage, overtime pay, recordkeeping and child labor standards affecting full-time and part-time workers.  The University must adhere to the requirements outlined in the FLSA regulations to remain in compliance.

On May 18, 2016, President Obama and Secretary Perez announced the final Department of Labor (DOL) update to the FLSA.  The final rules primarily focus on updating salary and compensation for Exempt employees.  The changes that affect most employees at USM institutions are staff.  The new rule increases the Exempt minimum salary from $23,660 to $47,476.  The effective date of the final rule is December 1, 2016.
